Man Hits His Own Car Then Sues Himself

LODI, Calif. - When a dump truck backed into Curtis Gokey's car, he decided to sue the city for damages. Only thing is, he was the one driving the dump truck. But that minor detail didn't stop Gokey, a Lodi city employee, from filing a $3,600 claim for the December accident, even after admitting the crash was his fault.

After the city denied that claim because Gokey was, in essence, suing himself, he and his wife, Rhonda, decided to file a new claim under her name.

City Attorney Steve Schwabauer said this one also lacks merit because Rhonda Gokey can't sue her own husband.

"You can sue your spouse for divorce, but you can't sue your spouse for negligence," Schwabauer said. "They're a married couple under California law. They're one entity. It's damage to community property."

But Rhonda Gokey insisted she has "the right to sue the city because a city's vehicle damaged my private vehicle."

In fact, her claim, currently pending at Lodi City Hall, is for an even larger amount _ $4,800.

"I'm not as nice as my husband is," she said.

If you're talking about the infamous McDonalds coffee case then this is a case that is often mentioned when people are complaining about how litigation happy the world is getting. However there are a few facts which are continuously overlooked.

1: The woman in question wasn't driving, she was the passenger and the car was stationary.
2: She receieved third degree burns to 16% of her body. She had to spend a week in hospital receieving skin grafts. This is because the coffee wasn't just too hot, it was dangerously hot. McDonalds knew this but refused to do anything about it because they felt the increased temperature improved the flavour.
3: She only sued them after they refused to compensate her for her medical expenses.

So this isn't a case of some idiot huting themself and trying to make some money off of it. It's a case of a corporation acting in a dangerously negligent fashion and being punished for it.

Didn't the woman's husband sue as well? Something about the woman not being able to perform her "wifely" duties? I think he got somewhere around $15,000 for not being able to have sex with his wife while she was recuperating.

Cool, DelWhicker. That Blueball machine reminds me of drawings I used to do as a child. Of course I used to enjoy drawing apple machines that would manipulate, skin, de-juice, carve into baseballs, and do other bizarre things to poor innocent apples. That, and for some reason I also used to enjoy drawing people standing in long lines, and sometimes I would draw mechanisms that would somehow affect the people standing in line. For example, elevators, escalators, harnesses attached to pulleys that would pull them up or side to side, trampolines, see-saws, that sort of thing. Thanks for the blast from the past. I wonder how a drawing would turn out now if I attempted it.
